History
Persons affected by the Tasmanian Family Violence Act of 2004 founded J.A.I.L. Inc. in 2008. Our membership consists of both men and women who are dedicated to take legal action against this unlawful and draconian legislation. The FVA has impacted in the most serious way by destroying families and has removed an individual's legislated right to a trial by jury. Persons who have received an FVO or a PFVO are now automatically deemed guilty until proven innocent. This illegal pro-arrest policy means innocent men and women are currently filling our courts and prisons.
Objective
Firstly, protect and promote families and children. J.A.I.L. Inc. objective is to overturn this illegal legislation. To this end we hired a legal team headed by Dr. John Walsh of Brannagh, one of Australia's most eminent authorities on the Australian Constitution, holds a degree in Criminal Law and is a former magistrate. On the 4th of February 2010, in the Federal Court of Australia, (Tasmanian Registry), we launched a Class Action writ against the Tasmanian Government. The trial date was the 7th of June 2010 in the Federal Court in Hobart. J.A.I.L. Inc. is seeking damages as well as the complete revision of the Tasmanian Family Violence Act of 2004. (Update July 2010) However this attempt was not successful. We have instigated another case in July 2010.
Why?
